Seller screwed me by applying for a duplicate title , lying that he lost it .?
I handed in the original title properly endorsed , payed the fee's ,only to get a letter saying my new title was voided because of a duplicate. I surrendered the one he signed to the Colorado Dept. of Revenue. What I do have is the( Bill of Sale, the cashiers check stub that I payed him with and my transfer title receipt showing the date I submitted it,and also the date of purchase of said vehicle. I do not have the Vehicle . He claims it is missing.

then you better get him immidiatly into small claims court no matter what before he spends the money too, he is in hot water, so keep the pressure up, he should have filed a stolen report, I suggest you go to the police and sit down and talk to an officer because fraud is involved in this now, In the end, that guy may be leaving, so jam him up with the cops, the small claims whatever asap, obviously he is hiding the car, that may get old for who ever has it, go to small claims, use the sheriff to serve him the papers, you pay extra, but it may play on his paranoia if he gets served by the sheriff he may start getting tweaked. good luck do what you need to do.

Okay, here is how it goes, you pay them the check, they give you the keys, the title and the vehicle.
Time to get the law involved. You should have gotten the vehicle immediately when you paid the money. Possession is 9/10's of the law. Since you have all the proper paperwork, you will need to go through the court system to try and recover your money.

Have the seller go to the Dept. of Revenue with you. He will need to apply for another duplicate title and pay the additional fee to get it immediately. Then, have him sign it over to you.

This is not a Small Claims case. He committed fraud and theft. File charges against him with your police department.
