Concerning getting a divorce, is it true that in some states?

you have to be separated from your spouse at least a YEAR before you can even apply for one? My daughter went to start divorce proceedings and her Lawyer told her that she had to be separated at least a year! She lives in SC. I live in PA and have never heard of anything like that. I got divorced many years ago, got a Lawyer and just started everything right away.

    Yes,here in the backwards State of Confusion,also known as South Carolina,you have to wait through a year of LEGAL SEPARATION before you see the inside of the divorce court room. Notice the large words there,if you're not legally separated,the year don't count and you've got to do it all over again. And now for the real kicker,have sex with your soon to be ex and the clock starts all over again too. I know one guy who has successfully put off a divorce for 10 years now by screwing his wife every year on her birthday.

    Where I live that isn't the case but, there must be a legal separation filed before the divorce proceedings can begin. You don't have to wait a whole year though. In other states though yes, you do have to be separated legally for at least a year before you can get divorced. It just depends on the state.

    Divorce laws do vary from state to state.I suggest that you call the county clerk's office where your daughter lives and ask them about this. They will know and will talk to you for free. (I lived in SC for 4 years and I never heard about this. But things do change.)

    well i dont know the states, but im in new zealand i had to wait two years living apart beofre we could go to court
