Can we recoup losses caused by a band member who refused to play a contracted gig at the last minute?

He told us he had a medical emergency and couldn't play the gig scheduled for that night. Turns out he'd been on a two day alcohol binge and was begging his wife to not leave him. He resigned with no notice a week later. Can the rest of collect lost income from him?

Update:

Actually, he claims that the 3 of us owe him money for merchandise he paid for with his credit card. Unfortunately, his picture is on the merchandise which makes it worthless to any of us now. In other words, his sudden resignation didn't allow us to sell the Tshirts, bumper stickers etc at contracted gigs through the rest of the year. We're stuck with something we can't sell because of his actions, yet he expects us to pay.

    You can try since you had a contract, but you'd have to go to small claims court, win the case, and then collect from him.
