Lawyer says I can't even talk to a br. in church, since he works for d/a. This doesn't sound legal?
My lawyer told me I can't even talk to a certain brother in church because he "works for DA". He is my home teacher. This sounds like a violation of separation of church and state, and free speech. Is this legal? I am under indictment, but I still don't see how these civil rights can be compromised.
He's a public defender. I am asking if this is legal, not advice.I'm pretty sure it isn't.
Peter, good one--Except: "accept responsibility"-? How am I "irresponsible"? By talking to my home teacher? My civil and religious right? Then, you say my "rights are protected"?
And, "indicted for violating the civil rights of a business or person"? I did No Such Thing, I am not even Accused of such. I am a member of the LDS church, this "crime" is "victimless".I have a lot of friends in the church , and letters from kin and friends submitted to the court to prove my character is good. It's a Stupid law. Many wake up in the morning to find They are suddenly a "criminal", too. There are too many laws, and the sentencing here is harsh.
That's why it's so stupid and hurtful.

Wendy: What brought This on? I didn't shout at you. I was only addressing a contradiction in Peter's answer plus the fact he doesn't sem to realize there are thousands of "victimless" crimes. Speeding, say 3 over the limit, no traffic; is just one example.
I am not arguing guilt or innocence with anyone, I am just asking on Legal grounds. You don't sound like you have first hand experience in it, either.

I suggest you do exactly what your lawyer tells you to do and not to do. Your lawyer was hired to represent you and has the knowledge to adequately do so in order to protect your interests. It isn't your civil rights that may be compromised, rather it is the relationship with a certain brother who works for the DA that has the potential of compromising your case were you to talk with the certain brother prior to trail as what may be said has the appearance of collusion with the DA's office which may cause the case to be thrown out and be re-tried. This is something you don't want to happen because you will have made the judge angry were you to speak with the certain brother and cause the case to be re-tried which may have a bearing on the penalty you will receive. Go with the flow, take responsibility for your actions, do what your lawyer tells you to do and not to do or say and you won't get in trouble with the court. Remember your lawyer is the one person you have on your side, so listen to your lawyer and don't try and find fault with the law as the law is on your side because you are presumed to be innocent until proven guilty. By the way, you are under indictment for violating the civil rights of ether a business or a person and your civil rights are also protected by the law, in fact your rights are the most protected as the courts don't want to convict someone who is innocent and the methods of presenting evidence protect you and your rights from self-incrimination, whereas the victims are not protected from self-incrimination.

Your civil rights are not being compromised. You have every right to ignore what the lawyer says.
And..maybe lose your case.

the DA is the prosecution that is trying to put you in jail. if you are under indictment it would not be in your best interest to talk to the prosecution. you might say something that would help them prosecute you.
