The end of july my family and i were involved in a car accident. we were going through an intersection....?

as we had the green light and someone else ran their red light and t-boned my car. my family and i were fortunate to all walk away pretty much free from any major injuries. right after the accident, my ankle got really really swollen, and it took weeks for the swelling and bruising to go away. It still hurts till this day to run and my range of movement in my ankle is limited compared to what it was before. Basically, now that a few months have passed I am seeing it will never be the same again. My insurance said I have a year to reopen this accident claim and I can file a medical claim if I want to. My quesiton is what does this mean? does this mean I am "suing" this person for personal injury? How does this work? I live in florida but the accident took place in mississippi. Serious responses only please. Thanks!

Filing a medical claim doesn't necesarily mean your suing the person if they had insurance you would simply be making a claim on there insurance for personal injury but if they don't have insurance and you still wanted to do a medical claim you would be suing them another option to is if you guys had insurance you can make a claim on yours either way doesn't really matter the state the insurance companies will take care of it and explain more depending on what you chose to do

if you file a claim on insurance, even after some time, you would be requesting compensation from their insurance to you....you will need forms from your doctor...because they are not going to just take your word for it, you have to prove it....just like if you were going into court. and it may take going to court to get it.
