Can we sue Apple for updates that ruin the phone?

I have an Iphone 4 and a 3GS, according to At&t I own them

So can we as a class action Sue Apple for updates that destroy a function of the phone

Jailbreaking

I want to use and buy apps outside of Apple's store and control

One must Jailbreak to do this

I want music on my phone that I did not buy from Itunes but other places and CD's I own

I tunes sync erases the music

My battery life is poor

I do not get a strong signal when I hold the phone normally

If the US federal Gov said Jailbreaking is legal

then why can't I sue Apple for taking a function away I need to install programs I use everyday?

Its my phone not Apples

From 1st gen to current I'm getting sick and tired of Apple playing games controlling what I do with the hardware. Its mine

Update:

Damage= limiting current function and monopoly on software apps for phone

Loss= Value of the device is less to me and others due to the limiting function with newer IOS

Update 2:

One answer is 100% off the mark, I own both phones 100% paid for out of pocket ( 500 USD for the 4) no contract for a phone but service yes, Geez some people

When you set up your phone on your computer through iTunes you OKed a user agreement that said (had you bothered to read it) that jailbreaking would not be allowed or compatible with new software. This has to do with the phone itself, not the service provider, the agreement you OKed was with Apple. So no, you cannot sue. If you did not want to agree to the terms and conditions of Apple, then you didn't have to and could have returned the phone. You do not have a legal right to own an iPhone, so therefore none of your rights were violated by the terms and conditions agreement.

You cannot sue because you are unhappy with a product. We have a free market economy, and you are free to purchase products from another company if you so choose. Same applies for the battery and signal arguments, don't like the product, then buy from another company.

As for the US saying jailbreaking is legal, all that means is that you can do so if you wish at your own risk, and cannot be criminally punished for jailbreaking the phone. The US law only prevents the Government from punishing you, it doesn't require Apple to provide software updates that are compatible with jailbroken phones.

Not sure about why you cant put music on your phone that you bought from other places either. I have tons of CDs that I uploaded to my computer and transferred to the iPhone.

i udnerstand were your coming from

but jail breaking is legal you just void your warranty with apple its like chipping an xbox or a playstation

downloading the paid apps for free from an illegal website is illegal. Apple isnt entirely responsible for this. When an app developer makes a paid app and puts it on the app store you are stealing from them. Its like downloading free music your ripping the artist off, apple just provides the apps and music for you.

And the poor battery life you cant sue apple for. Only if they have written down and specified that your phone will last for a certain amount of time with specifc apps being used for a specific amount of time set at specific performance level and it fails to do so, you could sue them for false advertsing and misleading you but you wouldnt win as you would have a hard time proving your case.

For the poor signal you cannot blame apple but you would have to complain to the netowrk provider you are with as they provide you with reception.

And for controlling apps i agree its annoying but thats why apple products never get viruses and dont lag because they are regualted so much.

someplace interior the settings, there's a variety which will reset the telephone returned to production unit settings. Please observe that this could reset the telephone to the way it grew to become into once you acquire it. it won't erase something on the SD memory card except you tell it to, so your music, pictures, and so on would be preserved (as long as you have them stored there). pass to Settings, then storage. Scroll down and locate the production unit Reset determination, touch it and shop on with the activates on the show.

You can sue, but this would be considered frivolous and you wouldn't win. They don't have to provide any service they don't want to and can limit anything they want to on their products. You have the choice to choose their product or not. You have no financial damages.

It's not your phone. I bet your contract even states that in some minor print. Since you aren't allowed to jailbreak anyway(HAVE YOU EVEN CONSIDERED WHAT IT IS CALLED) you wouldn't have any case. Remember possession doesn't mean ownership. I have a Driver's License, but it's technically owned by my State of Residence.

The easiest way to protest is to spend your Dollar else where.

As for trying to sue apple on those grounds, I doubt you would have enough cash to get by the first hurdle!
