What if someone dies who recieves child support?
My ex sister in law is receiving back child support for her grown son. She has very bad heart problems. If she dies. Who gets the support? Do they just stop collecting?
Its (Back) support Lawrence. Just because a kid turns 18 doesn't mean they will stop collecting what is in Arrears. I get it too for my 29 year old daughter. Just to clarify. This is a mistake most men make. They just assume it stops at 18 when they owe "Back" support. It does not. It stops when its paid up what he would have paid from the time the kid turns `18 if he's not caught up .
Tyler. He never "Willingly" paid it. As so many men, It is garnished from his wages. In his case, social security disabilty. Because he is a con artist and conned Disabilty into thinking he couldn't work. That is his only income. I'll tell you guys the whole story. My brother tried to get a passport to go on a cruise with his young new girl friend but discovered there is a law that prohibits anyone who owes back child support of more then $2,500 ineligable to get a passport. They won't issue it until its all paid! I imagine this is to keep dead beats from skipping the country before paying off their debts. . He called his ex wife and demanded she stop the support lol! She told him tough. You shoulda took care of your sh*t. So my brother calls back & talks to her current husband and tells him his wife is a sl**ut and doesn't deserve the money. (She only get $15 a month mind you.) Because the Public assistance takes the rest for supporting his son all those year

The money would be paid to her estate. If back money was owed,it must still be paid......

Back child support is a debt to her estate, I suppose, but if he paid the grown son directly, rather than splitting it among all her heirs, that would be probably more acceptable to the court. However, he might be able to get it csancelled if she dies. The estate can sue people. Not the heirs or the son directly, though.

She shouldn't be getting support for a grown son, it ends at 18. It sounds like a clerical error of some sort, or you must be mistaken. The one thing it could be is if he's unable to support himself do to medical reasons or something, then it would go to the son directly.

It is a part of the estate, but if there was a legitimate reason for the arrears, it could still be set aside.

i assume the child support would stop, or it may be able to be collected by her estate.
