Copyright infringement - Downloading Free Movies or Music In Canada?

I've been searching the internet for an updated and reliable source, but have so far been unable to find one.

I've always been told that it is legal to download copyrighted and/or pirated files using torrent websites, just as long as you do not contribute to the uploading process.

From what I've been able to find on websites such as Wikipedia, downloading copyrighted music files is entirely legal for personal use, but not for resale or commercial use.

However, I couldn't find any mention of other file types, and their legality.

So my main question is; is it currently legal, as of January 1st 2012, to download copyrighted files off of the internet, specifically movie files and/or video games?

Please provide some form of reference in your answer.

Important distinctions have been made about the legality of downloading versus uploading copyrighted material as well as "musical works" versus other copyrighted material. In general, the unauthorized copying or distribution of copyrighted material for profit is illegal under Canada's Copyright Act., however the act also states under the section "Copying for Private Use ... onto an audio recording medium for the private use of the person who makes the copy does not constitute an infringement of the copyright in the musical work, the performer’s performance or the sound recording.".[3] Furthermore, the Act contains a Private Copying exception that makes it legal to copy a sound recording onto an "audio recording medium" for the personal use of the person making the copy. This is supported by a levy on blank audio recording media, which is distributed to record labels and musicians.[

    I don't know if any new laws have been passed in Canada for this or not (I'm in the US, and we don't much news like this from Canada), but last I heard, you could download music as long as you did not distribute it. There is an extra tax on recordable audio material (CD's, cassette tapes, etc.) that goes to offset the loss of sales for this.

    However, you need to understand how torrents work. Using a torrent will be illegal. Why? Because you are contributing to the uploading process as soon as you start downloading, and any torrent client I have seen will not let you change this until AFTER you completed the download. But while the download is occurring, you are providing what you have currently downloaded of that file to others to download. Therefore, you have distributed the file, even for just a short time, and have violated the law.

    80. (1) Subject to subsection (2), the act of reproducing all or any substantial part of

    (a) a musical work embodied in a sound recording,

    (b) a performer’s performance of a musical work embodied in a sound recording, or

    (c) a sound recording in which a musical work, or a performer’s performance of a musical work, is embodied onto an audio recording medium for the private use of the person who makes the copy does not constitute an infringement of the copyright in the musical work, the performer’s performance or the sound recording.

    Limitation

    (2) Subsection (1) does not apply if the act described in that subsection is done for the purpose of doing any of the following in relation to any of the things referred to in paragraphs (1)(a) to (c):

    (a) selling or renting out, or by way of trade exposing or offering for sale or rental;

    (b) distributing, whether or not for the purpose of trade;

    (c) communicating to the public by telecommunication; or

    (d) performing, or causing to be performed, in public.

    I don't know what Wikipedia page you have been reading (please provide the link) but you cannot (legally), download music, movies, games or other files even for personal use, even if they are free. Not in 2011, not in 2012 not even in 1 AD.

    Thanks for the link, I was unaware of that copyright rule.

    Movies, games, photos etc (everything except music) cannot be downloaded (legally).

    As for music (I have only done a little research & will edit again if I find any better info) I stand by my original answer (read the 2nd paragraph under the heading "Music Recordings" of http://en.wikipedia.org/wiki/Copyright_Act_of_Cana... )

    Under Canadian copyright law you can only make copy's of music for private use onto a CD. DVD, (if you can even find one) a cassette. Copy's cannot be made to a computer HD or MP3 player

    Ok download Bittorrent. then when you want a song type in the songs name on google for example: Go on Google then type the song like ( Cha-ching torrent) then down load it from internet and it will appear on bittorent. Then if you have itunes add song to library.

    It's completelly illegal, but i still support it. In Sweden file piracy just recently became an official religion.
