Is it legal to shoot someone for breaking into your home?
Even if they don't attack you? Is it different for apartments? Also, say someone robs you on the street and is fleeing. Is it okay to shoot them? I live in florida
I looked it up. Deadly force is justifiable in Florida if someone is breaking into your home or vehicle, has already broken into your home or vehicle, or to prevent a forcible felony. Only justifiable in public areas (not home or car) if you are meeting deadly force with deadly force.
776.08 Forcible felony.—“Forcible felony” means treason; murder; manslaughter; sexual battery; carjacking; home-invasion robbery; robbery; burglary; arson; kidnapping; aggravated assault; aggravated battery; aggravated stalking; aircraft piracy; unlawful throwing, placing, or discharging of a destructive device or bomb; and any other felony which involves the use or threat of physical force or violence against any individual.

Yea as long as u dont kill them. Otherwise u'll get charged with involuntary manslaughter or manslaughter.

You can shoot someone in all 50 states. It all depends on the threat though. For example, in some states you can't shoot a person in the back. So if you run downstairs and the burglar takes off running and you shoot him, you'll go to jail. Most states say that the intruder has to be threatening you. So if you ask him to leave and he doesn't or he tries to approach you then you can blast him. Your best bet is to move to Texas. You can kill people to protect your property there. That's actually pretty cool in my opinion. A couple of years ago an old Texas man shot gun blasted two kids who broke into his NEIGHBORS house and got away with it. Shot them right in his front yard. Both of them died too.

You can't shoot someone who is running away from you, that person is not a threat to you.
In Florida you do not have to see a weapon or be able to prove you were in danger if you shoot someone who is breaking into or has broken into your home. There is a law called the "stand your ground law" that gives you the right to protect yourself if you think you are being threatened.

No, self defense is only good when you use only the amount of force necessary to keep yourself or your family from harm. if the mugger is fleeing away from you then you cannot shoot him because he is no longer a threat to you. You may not shoot someone to prevent them from robbing you or to get your stuff back.
