My mother is legally separated from my step father. Before they were married, she owned her current home. Once they were married, the home is both their names. She has owned the home for about 18 years. She received a mortgage interest statement the other day for the home with both names on it. She has lived in the home all of last year while her husband was not there. They are filing separately. Is she intitled to use this form alone or does her husband have to use it also?

Whoever actually *paid* the mortgage interest is allowed to claim it as a deduction on their taxes.
