Is it illegal to be high?
so someone at my campus said that it is illegal to be high and if you walk around high then you can get arrested. I corrected her and said that it is only illegal to possess drugs(in this case weed). I looked at drug laws and saw that the minimum punishment( a ticket) requires the offender to actually posses weed. If you walk around with red eyes and smelling like weed then a cop cannot arrest you because it is not illegal to be high or have drugs in your system, it is only illegal to POSSESS DRUGS. i just want to make sure with many people on here
i forgot to mention that i live in new york and go to a state school. since it is funded by the state then i think state law should override university law. plus university police on my campus are state troopers
@norskeye- i knew i would get atleast one answer like this lol. let me ask you something. do you drink alcohol or smoke cigarretes? if you say yes then you are a damn hypocrite
college is college. i get an education and for all the work we get we deserve to have fun on the weekends.

In most jurisdictions, it is not generally illegal to have drugs in your system unless you are operating a motor vehicle. However, there are a few jurisdictions where you can be convicted for drug use solely on the basis of having drugs in your body. Japan is the only place I'm aware of where this is true, but there are probably others.
You could, however, be arrested for disorderly conduct or on suspicion of being drunk, and kept in the cells until you sober up.
As for state law vs university law, you're right in saying that state law does override university law, but not in the way you describe. Even though the state doesn't have any punishments for being high, the university can impose penalties for it unless there is a state law specifically saying it can't. There is no state law saying that you can't be penalised for having drugs in your system, there just isn't a mechanism in the state system for that. And state troopers patrolling a university will know the relevant university laws as well.
So yes, it could still be illegal in your university.

It is illegal and it is a dirty shame. GO to college to learn and then walk around high. Is there no shame? Parents send their kids to go to school, give them money and then have the college call them and say their dope of a kid is using drugs. Why the heck would you want to mess up the circuitry in your cranial cavity??? Once the brain circuitry is screwed up, sometimes it can't be fixed. Your taking the chance of becoming a dope head. If you were drunk from alcohol, the Campus State Troopers could get you for Public Intox. You better stay in school and learn the proper punctuation and capitalization of your words. Looks like your brain is lacking. NO JOEY, I do not smoke or drink Alcohol. Marijuana does NOT save lives. It allows the patient to be more relaxed. I am not a Hypocrite. But I have seen and been around young kids that walk around High. What the Hell is wrong with them ? You mentioned students walking around high on Campus. You didn't mention week end fun. That is a total different time and place. What about studying hard. Work hard, play hard and study hard. There is a time and place for everything Drugs are horrible and after using them for a long time, the user becomes in severe denial. Admit that fact that drugs are bad. Look what happened to Whitney Houston. Drug Dealers are from Hell. Don't defend drugs. They do Nothing to help a drug user.

I'm going to assume you are American. It depends on your state. You could feasibly be arrested for public intoxication.
It's possible your friend was referring to it being illegal on campus. Universities usually have a pretty strong anti-drug policy and if security catches you high, they can kick you out or fine you. Depends on the university of course.
