Debt Collectors--time frame before suing?

I have been talking to a debt collector about money I owe, trying to work out an agreement for repayment. Can they send this on to an attorney (to sue me) if we are in the middle of discussing this...back and forth daily. **I am not sure what time frame is allotted for this collection, I have had my head in the sand for months--only recently having the funds available to start working out these obligations.

    The time frame to seek legal action in court to collect is referred to as the "statue of limitations"

    These statues vary from state to state. If the debt is beyond your states SOL, then it is considered "time barred" and they can not collect or seek legal action. If they did, this would be your defense.

    However, if you make any payment to them, then you have re-set the SOL and it starts all over again so best bet, check your States SOL and the link I provided in the source.

    It is very unlikely they will take you to court, as it would not be cost effective for collectors to take people to court. They could in theory, but it is almost never the case. Work out a payment plan or offer a cash settlement. If you offer to settle, insist (in writing) on getting a pay to delete, this will improve your credit.
