You can download DLC with a Silver (free) Xbox Live account as listed here: http://www.xbox.com/en-GB/Live/Join-Today

You only need the free silver version of xbox live. But you have to have some way to redeem the code and download the game obviously.
There are very small number of games that you can buy DLC on disk. Fallout 3 comes to mind. And of course you can get it for a lot of games in their Game of the Year editions.

if you are talking about buying DLC from retail stores like Gamestop then yes
Otherwise no. you need Xbox live
