Is it legal to start your own daycare centre at home?

For just a few hours a week.

Being monitored by a few 'staff' that are not qualified, but have experience.

What do I need to open up my own daycare business at home?

Could I organize trips out and car washes with the children and donate the profit to charity?

Could I still gain benefits while working under 16 hours a week claiming JSA?

Bear in mind I live in UK. I want UK answers only, thanks in advance!

Update:

I have 5 GCSE'S and 2 ASlevels with 1 Alevel. I'm not sure if that means I am qualified though. There are not many courses that will give me that option. I could ponder over doing a business course.

You legally require a childcare qualification, you will also need everyone working there to be CRB checked which will cost £44 per person. You will need someone there with a full first-aid qualification and organising car washes with 4 year olds for money would probably be considered illegal in some manner as well!

Doing a business course is fine but you will need registered nursery staff to work for you. It is an option so you can look into it but you will also need to pay business rates for your own home so look into those through the council as well. You'll need to alter faciilites to cater for young children including a downstairs toilet.

If anything went wrong you would be risking a long term imprisonment as all responsibility would be on your shoulders and you would have no qualified staff. Considering the maor issues around child abuse I would say just stick to babysitting your mates kids 1 or 2 at a time and take the cash, declare or not it's up to you!

If you work under 16 hours your benefits will be reduced for every £ you make minus £5.

Probably not. In most areas' you are not allowed to carry on a business from a domestic premises.

You cannot just 'set up a day care centre' there are a lot of regulations and legal requirement involved and you can not run it with unqualified staff. In no way could you take children under your care car washing no matter where the proceeds went. Yes trips can be organised but must be comprehensively risk assessed and closely supervised by adults including appropriately qualified ones.

Children are considered vulnerable so there are - and rightly so - stringent safeguards to be put into place. Your idea is effectively a non starter.

No. You have to be qualified, certificated and registered. And you have to fulfil very strict requirements - such as having fully qualified staff. You need to know the allowed ratio of children to adults. You would not be able to organise trips out with children without being fully insured. And no, you cannot still get benefits if you are running your own business, that's called fraud. But you would not be able to start such a business as it would be dangerous. There have been so many incidents in the UK at daycentres where staff ARE fully qualified that you have no chance of starting up such a business.

In the UK there are a whole raft of regulations. You would have to be qualified in childcare, have a clean Enhanced CRB check, your home would be inspected by the Council, you would need Insurances, fire inspections etc etc. And no you cannot claim benefits, you would have to register as self employed.

    Non Starter I'm afraid.
