I don't think the husband should "have" to, though it is usually the case. I guess it depends on where the kids will be staying and who the primary caretaker of them is. Most children stay with their mothers, visiting the father. However nowadays there are many variations to the norm. Does she want you to leave? If not than why divorce? If she wants you to leave you should respect that and move out until the court decides who is to be responsible for the home.

The husband and wife need to sit down and discuss things rationally. If they have a joint bank account, the money should be split 1/2 &1/2 , then take the other parties name off the account so there are no chances of either person taking more than their 1/2. If the husband has no where to go, that is something else to discuss together.

maybe no violence that you know of...people don't usually volunteer that sort of information. Actually it can go either way, there are many factors that need to be looked at. If his wife has 2 kids that are both theirs and he is the main bread winner and for some reason they cannot dwell together, then he may need to leave temporarily or even permanently.Sometimes both parties even dwell in the house together during the divorce process. There are so many factors that have to be looked at, but yes, it is possible.

Only if there is a court ordered ruling or a restraint filed against you should you leave.
