NC state revenue lost my tax payment and now ask for late payment fee?

I sent my income tax payment on time and I got a letter saying that I awe the NC personal taxes payment + late fee. I requested more information and they replied that If I send them the cancelled lost check they would consider it as lost. However the check is floating around and I have no way of getting it back. What do I do to prove that I sent them a check?

    If you issued a personal check, it is highly unlikely that you have a copy of the check. As a result, you really have no proof that a check was issued and even if you had a copy of your check, again, it is highly unlikely that you can prove that the check was enclosed in the envelope that you used to mail your tax return in to the North Carolina Department of Revenue.

    I think that you are out of luck and will need to issue a new check which will include the late fees as well.

    And do you happen to have a duplicate copy of this check or cashier check or money order receipt that you made out to them and then a registered return receipt from the post office indicating the date that they might have received the envelope that the check or payment type that you used for this purpose was supposed to be received at the correct state income tax NC department of revenue address for this purpose and time in your life.

    checks don't float around, your bank has record of it being cashed, they can provide you a copy of the cashed check, both front and back
