if I gave my roommate three months does that mean he doesn't have to pay rent?

Me and my ex- boyfriend decided to move in together again, but after moving in he became the boyfriend from h...! I told him it was not going to work both of us in the same house but he took one of the other rooms and said he would need three months to move. I said that would be fine but I found out today that he is planning on living rent free the whole time. I said this wasn't happening and he said to bad. what should I do, what can I do? The landlord gave me a lease with both our names on it, but then gave me another with just my name on it. I counted the first lease as voided but he still seems to think he is on the lease and he can now stay rent free. We have only been in the same house for 3 weeks.what are my rights.

so how can two leases be valid. That is like a will once its redone the last one is the valid one.

also are you saying he has the right to stay and not pay any bills. Come on that can't be so. That is saying I have no rights.

    2 leases can not be valid and unless the original lease was voided by all parties (you, your ex, and the landlord) it is still in force and the other lease is meaningless. As a result your ex boyfriend is threatening both yours and his credit by not paying rent. Legally when 2 people sign a lease, they assume responsibility for paying the rent together and separately. Thus if one doesn't chip in, the other is on the hook for the whole amount. And if the rent is not paid in full each month, both will suffer the consequences. If you are evicted you will not be able to secure a lease anywhere for several years. I have a suspicion that your landlord ran your boyfriends credit after you all signed the original lease, discovered a past eviction and then opted to write a new contract without the boyfriend.

    You could sue the boyfriend after the fact for both rent and utilities, but even that is tough to prove when you are boyfriend, girlfriend. You could hope that your ex does not have a copy of the original lease (or that the original lease isn't signed by all parties) and talk to the landlord about only honoring the second lease then changing the locks at the end of the month (just make sure the landlord has a key). And hope the boyfriend won't be able to prove tenancy. If he can, you will have to let him back in.

    Court is an interesting thought...but it's civil and if you win, you still have to make him pay and all you get here is the right to put a lien on any stuff he has or will have and then you have to constantly renew the lien. First be sure the landlord isn't keeping a copy with his name on the lease. Then call the police and tell them that he doesn't have your permission to be there...yes lie...he never signed a lease and came and just moved in without your permission. You can also say that he is threatening you and that he said he would harm you if you called the police. Tell them he said he plans on staying there and won't leave. Tell them you are afraid of him. He deserves whatever happens. He wants to play games...make him regret that. No one has the right to live anywhere and not pay their share. The other thing you can do is evict him as his landlord. I don't know the rules where you are but you must follow them and in some places that takes awhile. With no lease you can also give him written notice to move in 30 days because he is a month to month tenant. But if he isn't paying and he is staying...screw him. He's screwing you . Play the better game.

    You are going to be liable for that lease. Your best bet is to continue to pay rent so that you don't damage your credit or standing with the landlord. The matter with the boyfriend is a civil matter and you can put out more money to hopefully get a judgement against him in court but it sounds like he wouldn't pay that either. You may just lose out on this one.

    The lease he signed is in fact valid until you obtain a court order to remove him. He can stay as long as he wants, or you obtain the order.

    some peeps attempt to carry on to factors their total life. THis, isn't a level in any respect. Her turn is her turn. You nor all of us else advantages a thanks for doing what you're meant to. Goofy roomate. If she needs a thanks, write her a letter and make it somewhat relaxing. passive aggression is honestly relaxing and the different individual hardly receives what you're quite getting at. only an concept

    Give him 48 hours to move.

    Start making life unbearable for him.
