If my employer does not pay my income tax to the IRS, but I still have a paycheck stub and a W-2?

that has my withholding listed. Am I still able to file to receive my refund? I understand that i would not be liable if they are not paying and i was to still owe that money. I'm asking, if I will still get my money back in a return in February, if it is not being sent to the IRS.

    It does not matter to you if your employer pays over your tax to IRS or not as long as it gets reported but if he doesn't start looking for another job because he is in financial hot water and may not survive long.

    When they did send the W-2 out to you and to the SSA and then to the IRS every thing was correctly reported after the end of the tax year for this purpose and time in your life.

    Do not lose your copies of your W-2 forms that you do say that you have in your hand at this time in your life. And your copy of your 1040 income tax return that you did fill out and file to the IRS for processing at that time in your life.

    You'd be OK, and would get your refund. Your employer on the other hand would be in deep sh!t.

    if the employer is not reporting and paying the payroll taxes and withheld taxes that is embezzlement on his part

    you are not involved, it is not your concern
