Washington State and Colorado voted to legalize marijuana in last week's election?

My question is, do States' rights in this supersede any federal drug laws. I read USC Code Section 841 which deals with controlled substances and all I could find was reference to detectable amounts of marijuana in mixtures weighing 1000 or more kilograms or 1000 or more marijuana plants.

    The Feds still have the right to make arrests if they think it would do any good coming into Colorado and busting people for under an ounce of marijuana possession. One arrest may cost them thousands and only result in a $100 fine and no jail time for the "perpetrator" so it is highly unlikely they will bother spending their resources this way. As far as local police go, they will no longer ticket people in Colorado caught carrying under an ounce unless there are other crimes involved. And I got that information straight from a public official yesterday. So no, state rights don't supersede federal law, but in the case of marijuana in CO and WA, I don't think federal agents will even try to enforce this one.

    Marijuana is still completely illegal on the federal level. If you have any marijuana, regardless of Washington state law, you are breaking federal law.

    The Feds can come in and arrest you at any time, regardless of whether or not you are breaking state laws. So, if you are over 21 and smoking marijuana, but the feds catch you - even though you were following state law you aren't following federal law, and will be arrested.

    Isn't that ****** up?

    Technically you are supposed to follow the stricter of the two laws. Even though marijuana was legalized by the citizens of the state, it is still illegal under federal law. So the D.E.A. can interfere and arrest people. It's going to take a while for the will of the people to filter up!
