Question about videos...?

I want to upload a video of me playing basketball to show my friend who lives in Portugal. The thing is, I play at my gym, and they play music.

So, what I'm trying to ask is if I upload the video with the music in the background, will it be taken down for copyright infringement? If it will, is there anything I can do? Also, if the music volume is lower, will I be okay?

Just some additional information:

+ The music isn't loud, but it can be heard in my video (I've already recorded it).

+ I do speak for most of the video.

+ I will make the video private.

    It depends on the music, as copyrights expire after a specific number of years. You could also post a disclaimer in the video, or the description.
