Give him a heads up or no?

Taking my ex-husband back to court for more child support. I gave him a break on the amount because he was seeing our child more than the decree stated. But cost of living is rising, I'm definitely covering the majority of costs for our child and he has since gotten a promotion and raise. Also, when I gave him the break on the amount, it was with the understanding that it would be up to the legal requirement within a few years (it's been 3). I'm pretty sure I know how he'll react either way, but I don't want to blind side him with legal papers getting served to him at work. Just looking for some outside opinions here. Up or downsides to letting him know what I'm planning. Thanks!

    Is it possible that he might agree to paying more support if he was asked? Did the court set you amount of support to start with? If you think that he may pay more support if asked, then why not just meet with him and ask. If the court set the amount to be paid to start with, he is very likely going to find himself responsible to pay the arrears that were not met from the time that support originally ordered. If this can be done peaceably, then talk to him first. If you think that it is only going to result in a battle between the two of you, let the courts handle it.

    I would just take him to court with no warning. I think if you tell him he will likely try to convince you otherwise and you need to do this for your child.

    why don't you talk to him about it first you might not even have to go to court over it
