Can I claim this money ?
On December 7th 2012 I was rear ended on the freeway after coming to a complete stop because I saw two cars randonmly stopped . I was sandwiched meaning pushed into the other car . .. Obviously the guy is at fault. Yes his insrance paired etc.... They gave me 90 days to see a chiropractor and I never went . Can i claim those 3,000$ dollars never used ?

No, you're not entitled to money for medical expenses that weren't received. The person that hit you has medical coverage, but the coverage wasn't used and doesn't need to be paid for. Just like if you were in a wreck and didn't need a rent car, but had rental coverage. They're not just going to write you a check for the rent car that wasn't used. I'm really glad you weren't hurt and didn't take advantage of the situation. Just put this behind you and move on.

No. You cannot claim medical care/ pain or suffering if you were not injured or got medical care.
