What is an irs hardship?

I have a student loan in default. I owe about 6700. The irs offset my tax refund for 6100 so i now owe about 600. (my husband had a debt to pay also) Ive been talking with CTI who now has my account. They are telling me I can apply for a IRS Hardship and may get some of my refund back. How does this work? She sent me an application but even though I really need money at this time if I do it then I'll still owe more then the 600. Can someone tell me if theyve ever heard of this?

My husband is the only one currently working. We were involved in a car accident on Christmas day that left my daughter with a brain injury. She isn't able to attend school yet so Im at home with her everyday and taking her to therapy all week. Im not sure I want to do it anyways since Im so close to having it paid off. But Ive never heard of them giving money back!! Right now our monthly expenses are more then what my husband makes and my mom and her husband have been helping us get by until i return to work.

    You basically would be eating dirt to be able to qualify for this.

    You have jobs? No hardship.

    If I were you, I would be glad this got paid down this much.

    I would be happy to know that soon I could pay off the other $600 and eventually have this showing as PAID on my credit reports.

    There are different types of hardship cases. One is a way to borrow money from an IRA for an approved hardship. Another is when a taxpayer owes taxes and can't pay and has no income above necessary needs and no assets, and no way to borrow money. The IRS will still hound you for the money and by filing a hardship form(433 I think? you can stop them for harassing you. In no way at any time I know of has the IRS ever returned money to a taxpayer under your circumstances once they have taken it. Go to <irs.gov/hardship case guidelines > and that should tell you more than I know and that is from the source. Best of luck to you. I'm so sorry to say they are some heartless b__terds.     it would appear that a good part of the obligation was paid with the refund that makes it much easier to look forward to the time even that will be paid off

    I have no knowledge of an offset being returned to you by filing any hardship

    once it is offset the agency that claimed it is not giving it up
