Ti ricordi la framosa frase di Shakespeare: To be or NOT TO BE ? (essere o non essere)
Come vedo il "not" va posto prima dell'infinito. E se lo ha scritto lui.....

La prima è giusta perché 'di non, a non, per non' si traducono con 'not to' e anche perché nell'infinitive non esiste 'to not + verbo'
esempio: I told him not to say a word/not to go/not to talk, eccetera.
