how does .99$ equal 750$?
The minimum civil penalty for downloading unauthorized music (according to the RIAA) is 750$ per song, a song that would normally cost about 99 cents. What happenned to the 8th ammendment?
Greg, you must not be familliar with the 8th ammendment, "Excessive bail shall not be required, nor excessive fines imposed". 750 times more than how much the item is worth can only be called excessive.
Goldfly, while this is true, and also beyond the scope of the question, most of the time it is only 1:1; it is downloaded once, then the same amount is uploaded for a net loss of 2$ assuming the person downloading or uploading would have bought it had they not downloaded it.

So you are struggling with the concept of crime and punishment??
What you think that has to do with the 8th Amendment is beyond me.
EDIT: Let me clarify. THE LAWBREAKER does not get to decide what the societal cost of breaking the law is.
Stealing songs..... ends up making it less likely that artists will create and share any NEW songs...... and that has a cost to our society and economy that goes WAY beyond $1.
EDIT: Let me say it again. LAWBREAKERS don't get to decide that. "We the People" do. DETERRENCE is not unconstitutional..... rather... it is THE ENTIRE POINT.
If the punishment for STEALING was comparable to simply paying back the AMOUNT STOLEN.... then where is the incentive to actually pay rather than at least TRY to steal?

You UPLOAD a song, because these P2P sites rarely allow you to just download, you usually have to go both ways, and that allows OTHERS to download it. That means you aren't considered to be stealing it just once, you are allowing others to steal it as well.
