Can a person be fired while out on disability due to surgery? Can they take away your health insurance while?
you are disabled? This is happening to a friend of mine. I remember that they could give away your particular job, but had to offer you another job. I also remember that they couldn't take away the insurance. Have the laws changed?
It didn'thappen on the job. It isn't a workman's comp thing.

Workmans comp?
Yes, yes and yes.
If she's on workmans comp, she's covered medically (for her injury) under that. If she's not working, therefore not paying her health insurance premiums, they can cancel her health insurance. And they can "let her go" if the injury makes it impossible for her to do her job, or the company downsizes, but she'll get a settlement for the injury.

Tell her to watch her mail and make sure they don't file to close her case with workmans comp.

They do not have to keep your job open, nor are they required in most states to offer you another position unless they are subject to FMLA. They can take away your insurance if you are no longer working there. However, if the employer group policy is subject to COBRA regulations you can get COBRA coverage.

No if the surgery was necessary because of something that happened to her on the job. Otherwise, yes.
