If I hire an independent contractor, such as a freelance interpreter, can I.....?

Ask them for their Driver's License and SS card? They're not filling out an I-9 because they are not an employee. My HR manager and I are disagreeing on this but I would love a professional opinion. I say they shouldn't have to show us their ID's and she says they should because they could be illegal aliens and we can get in trouble for paying illegal aliens. These folks are signing an IC agreement and sending us a W9. I just need to know if we can legally ask them for their Driver's license and SS card.

    For IC's, you are only required to collect their W9. On it, the payee certifies their name and EIN or TIN, that the payee is not subject to backup withholding, and they are a U.S. person, including a U.S. resident alien.

    As the payor, you are only held to a "reasonable person" standard in terms of questioning the W9, in other words situations that a reasonable person would/should find questionable. For example, a W9 with an EIN of 88-8888888 or a local address with a far-away ZIP code.

    You may, but are not required to, verify the W9 by matching the TIN with the taxpayer name. Check the IRS website below.
