If you were a landlord, what would you do when your tenants were late with the rent every month?

Last months rent was not paid till 2 days before this months rent was due, and they don't have this months rent.

    I am a landlord. I would not put up with this at all. The first time they were late with the rent (late is for me after the 3rd of the month)( I would charge them a late fee (which would increase with every day late). The second time late I would give them a warning notice that continuing to pay rent late may result in eviction. THe third time the rent was late I would put a 3 day pay or quit notice on their door, indicating that if they don't pay in 3 days they will be evicted. Then on the 4th day if they haven't paid rent I would file an unlawful detainer lawsuit to evict them.

    Also, once you put a 3 day pay or quit notice on their door, it is very important that if you really want these people out (and you should get rid of people with a pattern of paying late) that you do not accept any money from them after the 3rd day. If you accept any rent payment from them then you void your 3 day notice and cannot file the eviction in court.

    Learn the laws, learn the eviction procedure, and learn how to deal firmly with tenants or they will walk all over you and take advantage of you.

    Talk to them and see what the problem is. Possibly they are trying but are having trouble making ends meet and are struggling in order to pay the rent they do pay. Or they are bums who pay occasionally just to shut you up and spend the rest on drugs. You could validate everything they say with a credit and background check. Do you know the source of their income? If after you talk to them and check out their financial situation, you can decide whether they can or can't afford your rental. If they can afford it, let them know in no uncertain terms that you have tolerated late rents for the last time. The money they get at the end of this month should be going to next month's rent. In the future you will give them a 3 day notice if it's 5 days late and charge a late fee. If they haven't paid after 10 days you give them a 30 day notice to move out and apply last month's rent to it. If they haven't moved after 30 days file an eviction lawsuit. If you find out they are struggling because they aren't living within their means...they can't afford the place, give them a 30 day notice and follow through from there. Good luck.

    What does the lease say? If you don't have a lease, you can certainly have them sign a new tenancy agreement, upon 30 days notice, which includes late fees and other rules about being late on the rent or anything else that bugs you. They then have the choice of agreeing to the new rules or starting to look for another place to live.

    Under MOST state laws, you can give notice of intent to evict for non-payment of rent the FIRST day after it was due. Laws vary as to how MUCH notice must be given, but it is often less than 7 days, after which the tenancy is considered terminated and you can begin the eviction process...

    Per most lease's,rent is due on 5th of each month,if not paid a late fee is assessed,if rent is not paid by 10th a 3 day pay or quit is posted,if not paid by end of three days eviction process is started.When eviction is started,do not accept any rent or the eviction is null and void and you start all over.If they are habitually late with rent,this is how you proceed.

    You have a problem and need talk to them about it. If they are good tenets and like the rent is do on the 1st. And they explain they are payed on the 15th and can pay the 16th every time. I would say yes that works. But if they get more than a month behind I would be looking for new renters.

    If I was a landlord, I would have made provision for this in the lease agreement. If you have no valid lease agreement, then you have a problem bigger than your tenants slow payment. At least they are paying and your real problem is how to evict them many,many months down the road for non-payment. I'm sorry you need the money that bad. Yeah, yeah I know you got bills to pay. Sell the property and dump the drama.

    I would of evicted them when they were even 1 day late with rent. If your a landlord, learn your rights and stop being a doormat to deadbeat tenants.

    Charge them 'late fees'. $25.00 if late three days, an additional $25.00, if late a week. After that, an eviction notice. If you have other tenants, even if they pay on time; it would be a good idea to give them written notice of the rules.

    Maybe start making them pay in payments so rent is fully paid off every month. If not, kick them out.

    Charge the late fees as outlined in the lease.
