Can you shoot an unarmed man in self defense if?

that person is much larger than you and/or much younger or you're in poor health and you feel that person could do serious damage to you? For instance, I am 52, diabetic, bulging discs in my back and neck, arthritis in my knees, high cholesterol, etc. If a much larger or younger or both person attacked me and I felt he intended to do me serious bodily harm with his bare hands could I shoot him in self defense?

    You probably should talk to a local police officer to get your answer for your area. I live in Georgia & YES, here you could shoot in self defense IF you feared for your life!!! However, you would probably be arrested & have to defend yourself in court. Also, are you licensed to carry a concealed weapon??? IF not, that's a whole new ballgame. Actually, from what you're describing, you could shoot almost any teenager walking down the street & try to claim self defense...you sound fearful of almost everything!!!

    Generally self defense rests on two facts. You attempted to defuse the situation, and the aggressor refused to back down and was not only capable of killing or injuring you, he continued the attack. You may not use more force than required to defend yourself and you can't 'punish' the aggressor after he's no longer a threat. You may shoot while he's attacking, but once he ceases the attack you may not shoot him again. At that point you MUST call the police and report the shooting.

    Why are you so keen to murder someone?

    Anyway, it would depend. If you just start shooting at people who are going about their lives, then that's clearly murder. Unless of course, you're White, the people you murder are Black, and you live in one of those "You can murder anyone darker than you are for no reason" states. Kentucky may well be one of those states.

    If you're that disabled, and a huge person attacks you, how would you even be able to kill them?

    The fact that you're leaving a trail of evidence of your intent to murder people could very well show up in your trial. So I don't recommend it.

    The law says it's self-defense if you are "fearful of imminent bodily harm". So, technically it would be self defense. However if you were prosecuted, it would be pretty compelling to say you weren't in fear of harm since you had gun and he didn't.

    Not the same thing as afraid for your life.

    Kill an unarmed man and in civilized places you must be prepared to defend you actions.
