At the time of the Civil War the South had won several important political victories for the issue of slavery. In 1849 slavery was confined to the slave states. In 1850 the Fugitive Slave Act required citizens of the free states to be deputized to capture and return people alleged to be fugitive slaves. In 1854 the Kansas Nebraska Act repealed the Missouri Compromise which meant all territories were now open to slavery. At statehood a territory could vote to be a free state but before that slavery could not be excluded. Finally, in 1858 the Dred Scott Decision denied all African Americans, whether slave or free, the right to be citizens and in fact all rights under the law. At that point America was a slave country with a provision that individual states could be an exception to the general policy and be free. The contrast was that the free states choose to maintain this exception to the general law. And Abraham Lincoln pointed out that it would only take one more decision by the Supreme Court to require slavery in all of the states.

Even though they both were potentially Racist the North were more tolerant with Blacks than the South.
