if you commit the same crime a second time will you get more jail time?

my sisters boyfriend committed an assault about 12 years ago and got 30 days in jail and he served his time on weekends. Now he is being charged again for assault and plea guilty. His sentencing hearing is tomorrow. Do you think he will get a longer jail sentence this time? They live in Canada if that makes any difference......

Update:

he had at least one conviction of drinking and driving there about 3 years ago. The first assault was on his mother the new assault was on my sister. He grabbed her by the throat. he has a restraining order to stay away from her.

    Yes. The more crimes you commit, the harsher the sentence you are likely to receive.

    Criminal punishment in Canada is based on two principles -- deterrence and protecting the public. Most people don't want to go to jail and a short sentence for a minor crime is enough to get them not to commit any further crimes in the future. This obviously isn't the case for him. He's now committed two additional crimes. In addition, assaulting someone under a restraining order is going to be taken more seriously. Depending upon the nature of the assault, he is likely looking at more serious jail time -- months if not years.

    This assault did it cause bodily harm & has he had any priors during those 12 years other than assault

    would make a difference in answers here. It may be one or the other --- probation & fine or 60 days.

    Did his lawyer see what prosecuter wants on disclosure. If he did bodily harm he will do a longer period of time. Im from Canada. DUI 3 yrs ago. He is showing judge he cannot abide by the law, he will do 60 days or more. My question is where is the disclosure.

    Usually, yes...but it will depend on the cirucumstances of the case, and 12 years ago is quite a while.
