who is at fault when a dog,uncontroled,unattended out in the country,runs out and gets hit.?

The people who own the dog want to sue me for the dogs vet bills,because they say i'm at fault.The dog was running wild and free down the road in the dark,7;00pm at night loose,ran right in front of my truck,i hit it and it put my truck in the ditch,they say they will not pay any of my bills.

    It's their fault. It they sue you, counter sue them for the damage they caused to your truck and any medical bills that you might have. If their dog wasn't running loose, nothing would have happened. When some sues someone else in a court of law, it's their burden to prove the case they are suing for. They can't win in a court of law, because it was their fault that the dog was not contained. Since it WAS their fault, if you counter sue, YOU will WIN your case.

    Here's the problem: Was there a police report made? If not, nobody has any proof that anything happened anyway. Just because there is damage done to your truck and they have a dead dog, doesn't prove that either of these cases has anything to do with the other. I HOPE YOU called the police.

  • They are at fault. The road is made for cars, not dogs. Unless you were going too fast or you left the scene and didn't report it properly, you can sue them for damages to your truck.

    I don't know about you, but I'd be pissed if someones loose dog caused damage to my precious classic car. And I say this as the owner of two dogs whom I love a lot; however, my dogs are never loose in the street.

    It is their fault and they are crappy owners. In my town/county there was a dog hit a few houses from my house. The dog owners where harassing the driver that hit the dog and his family, demanding money.

    Animal control informed the dog owners that they where at fault and that the driver of the car or anyone else driving the road could also go at them for any damage to his/their car acquired from the dog running loose. I suggest that you find out what the animal laws are for your county/city. As far as I know it has always been the fault of the dog owner.

    Well at this point I don't know that you'll be able to do anything... I'm not legal expert.

    The owner of the dog is ALWAYS liable for what they do when they're off leash. That I do know for sure.

    They are legally liable for damage to your vehicle as well as the tow cost. HOWEVER, I don't know how you can prove that in court. When it happened you would have wanted to get a police report. Hopefully they are prideful enough to come to court or sue you themselves because if they go to court and tell the truth you will win... No doubt about that.

    I`m in the UK and If a dog caused damage to my pick-up because it was running loose on a country road i would expect the dogs owners to pay for the damage.

    If they refused then I would seek a lawyers advice and help.

    But it could get messy and complicated if there are no witnesses on your side.

    You have to ask yourself if its worth the expense of hiring a lawyer and will it be more than than the cost of repairing your truck?

    Life`s not fair sometimes damn it, and you just have to grin and bear it. Jmo.

    there are a FEW freerange states where livestock IS allowed in the road and your fault if you hit the cow - not sure if dogs apply even in those states - but most states its their fault

    but this is grief talking - unlikely a lawyer would take the case and if you sue them its gonna depend on you to prove hitting the dog did the damage

    You can sue them in small claims court and you would win. They were negligent in letting their dog run free so any damage from that is their fault. Don't let them bully you, they can sue you but the judge will laugh them out of the courthouse.

    I'd say you have a case. The dog should have been secured. Check with a lawyer as to what the local laws are.

    Well, a dog is a living animal, your truck is not. How fast were you going? are you living in rural or urban areas? Do you have leash laws where you are? Again, most urban places do have leash laws, but the majority or rural places do not. Were you going at speed limit? It really depends where you are, and what the circumstances are. I would help pay the vet bill because I'm a kind person and would feel awful.
