If someone is wearing a deer costume on hunting grounds during hunting season and you shoot and kill them?

is it considered third degree murder?

    it would more than likely end up being at most manslaughter, but if the prosecutors can't prove you killed a person with intent or even knowing they were human, they would more than likely drop the case and deem it a accident. this is on par with hitting someone with your car who's jaywalking on a dark stretch of the road, you had no intent on killing someone and they were not supposed to be there in the first place, so the prosecutor would likely drop it saying it was a accident.

    Its probably first degree stupidity to camoflauge yourself as prey, unless, of course, its an international orange deer suit. But if you shoot at an orange deer, it would probably be second degree murder. yeah you didn't leave in the morning to shoot the idiot in the orange deer suit, but you siezed the opportunity.

    Someone must be an idiot, and if you kill him/her, you must be too. Deers have four legs! Yes, it is murder and probably suicide (on someone part) too.

    Probably not. How was the shooter supposed to know it was a person? It would probably be ruled accidental or a suicide.
