Does an employer file workers' comp regardless of whose fault it was?

My understanding is an employer is supposed to file every incident with workers comp even if it's not their fault. However, worker's comp will either choose to pay or deny the filing depending on their determination as to whose fault it is. Is that correct? New york state if it makes a difference.

    The employer is fully responsible for compensating the injured individual or team of workers if the unhappy events happened on the territory of the respective workplace. There is a workers compensation insurance for every employee that helps them cover their medical expenses during the treatment.

    Right. Worker's comp is "no fault" liability, meaning your injuries are covered regardless of who caused the accident. The only exception is if you intentionally hurt yourself.
