Is it permissible by law to use someone elses logo?
I am starting up an online business and now up to the very difficult stage of finding a logo. I have no creative bone in my body and there are 100s of logo designers on the web and I have no idea who will do a good job.
I have found the PERFECT logo but the only problem is that it is taken (by who I don't know). My company name is Pick of the Litter (Australia) but apparently there is a Pick of the Litter in the U.S...
I really want their logo but just change the colours of it.
Is it permittable by law to use someone elses logo based on them not copywriting or trademarking it as well as them being in another country?
Yes I have to ask that as the persons company doesn't even exist and yet they feel they can hold onto a logo... That is like holding onto a company name when you are no longer trading.
