In my opinion it was second degree murder.
Stewart never slowed down, he must have seen Ward.
Stewart probably thought Ward would jump out of the way in the last minute .

Kevin Ward was foolish getting out of his car and running on the track into traffic. I wish I could see a clip of the whole track leading up to it and whether or not Stewart was accelerating to get around the track when everyone else might have slowed down for a flag. I don't think he intentionally hit him, but he could be blamed for ignoring caution condition.

Kevin Ward was just a victim of a dangerous "sport."
But he died doing what he wanted to do---race cars.
If anyone is at fault here it is NASCAR, not Stewart.
Other sports try to make it safer for their players but
NASCAR is still living in the stone age. Make things safer
for the drivers.

Even though he ment to scare him, he will never be charged.
