What should I do with an upside down car?

Update:

I am in the process of a divorce and the lawyers are telling me I have 120 days to either refi or trade my car in since it has both names on the loan. The car is a 2013 and is about $7000 upside down. I have tried all the local and national banks to refi the vehicle but no luck and can not figure out what my next move should be. Any advice or help would be great.

    If you cannot get your lender to extend the loan to you with cash back to pay off your wife put the car into an auction and sell it to pay off the finance and then give your wife half of the remains. Divorce is expensive as your are finding out. An auction meets their time frame and shows you got the best price you could.

    You do not say what is outstanding on the finance.

    If it sounds bad as it goes into the auction hall it will get less money.

    The car is worth about $7000 minus outstanding finance.

    She has had benefit up to now.

    You can get a mate to buy the car at auction then finance it on a bank loan and buy it back to keep it or just buy another car.

    Go to your current lender and talk to them. Tell them you will take over the car in your name only and continue to make payments as per the original loan. Or they can have the car back and try to sue you and your ex for the $7K. It will be a lot cheaper for them to let you carry on as is.

    Or you tell your ex's lawyer that you cannot refinance the car and that you will quietly continue to make the car payments until it is no longer underwater. And once it is no longer underwater and you can refinance it you will have their name taken off the title.

    My point here is that you do not have to do everything the lawyer says. You can tell them what you want and make counter offers to what they say. When my ex and I split their lawyer came to me with a bunch of demands. I countered with what I felt was a fair offer but one that worked a lot better for me. My lawyer was mortified so I did not invite them to the meeting. We worked out a far better settlement. Because in this case it is not like your ex has any equity in the car.

    Stand up to this one. Be fair but do not take this bullying sitting down. And you do not need to pay your lawyer to present it as they will charge you a lot for doing so.

    You pay it off is what you do, great business decision to get you in this position and congratulations on the divorce, I'm sure she will be much happier with her new boyfriend nicknamed "Donkey Dick" giving her what she want's and need's on a regular basis. I'll bet he tears that pu$$y up every night, oral, missionary, doggy, etc. Now, what was your car question? Something about being upside down? Maybe your wife was upside down while mule plowed her garden.
