Is This Legal Or Not.?
My daughter gave her CV in to a rather small, unsavory,job agency yesterday and was told to go back today for an interview. The interview turned out to be more like an interrogation. It was a terrible, unhelpful, and degrading experience. My daughter came home in tears.The woman in question said there was nothing she could for her. For that reason my daughter asked for her CV back and the woman said she would not do that. When my daughter said, but it s private and confidential information for me only, the woman still refused to give it back but in an angry tone said it would be shredded. I am not happy about this at all as this information could be sold on to immigrants who she apparently does a lot of work for. Was it legal for her to keep this CV? Any advice will be so welcome. We have just seen that this woman has nothing but bad reviews. Thanks for your help.

Once a CV is given to an agency, it is now a property of the agency. Every information in that CV would be kept confidential by the agency. That is the reason why people give CV to agency for them to be given a job or offered a job by the agency. Your daughter has the right to ask her CV back to her, that mean she is not anymore interested in applying for the agency. And some agency do return back CV's for that matter. I do not why this particular agency refuse to return your daughter CV. It is much better if you personally drop by the agency and ask your daughter CV from the agency. If they refuse ask them why. What is the purpose of keeping the CV is your daughter is not anymore interested to take part in the agency. I think this woman needs a tongue slashing from you if she refuse to return that CV.

First of all, I am shocked by the arrogance of that interviewer at that agency. Here is what you do. Write to the agencies senior director, and name the woman who acted in such a cynical way towards your daughter. Make it very clear in your letter that you are totally dissatisfied at the way the interview was conducted and that you are making a formal complaint. Secondly, DEMAND the return of the CV, and clearly state that if it is not returned within 14 days, you will be taking legal action against the Agency for withholding personal and private information they have no legal right to. They will have no idea you would not be taking this action and it may jolt them into returning it. State clearly that if you do not hear from them within 14 days, that the next letter they receive will be from your solicitor, with a summons to court. Finally, get a new CV written up for your daughter. I can help with that if you are in the UK.

Did she say why she couldn't do anything for her?
That would arouse some suspicion, since there should be a job for just about anyone unless they do not have proper working papers.
Technically, your daughter shared her private information with her, and it is the property of the employment agent. By the time she went to the back office and returned, they could already have made a copy- so her not returning the original copy means very little now. It goes without saying that in the future, she should do more to check out anyone with whom she is going to do business - this shouldn't have happened in the first place, but now that it has, I don't think there's much you can do. At least if there is a problem, she will know exactly where to look for the culprit.

A CV would only have her name and address and DOB. There is nothing to be forged, they would need bank details and an NI number to assume an identity.

Yes it was legal for her to keep the CV becaise it was given to her by your daughter. It wasn;t confidential, because they were actually given it for official purposes.
