If I have turned in my 30 day notice, my rent is paid up and I am in good standing, can my landlord still try to evict me?

    I'm getting a divorce, the home I have lived in for the last 10 years belongs to his Grandmother. The divorce court judge asked me if I could find a place by 5/1. I told her I would try.

    I found one finally, but it isn't available until May 23rd.

    My ex husband says, that if we are not out by the 1st of May, they will evict us both. Both our names are on the lease. We go to court on 4/23. I plan to tell the judge.

    Can they evict us if we haven't broken our lease agreement or these eviction reasons presented by the courts: To evict you with a 7-day notice your landlord must have a reason and state that reason in writing.

    If you are a tenant at will no lease the reason must be one of these we've not broken any of these

    You have seriously damaged the apartment and have not repaired the damage.

    You have been a "nuisance" to other tenants or neighbors.

    Examples: You pick fights with your neighbors don't let them sleep or destroy their property.

    You have made the apartment unlivable or unfit to live in.

    You have changed your door locks and have refused to give your landlord a duplicate key.

    You are 7 days or more behind in rent.com

    If I contest the eviction and it is overturned, will it be removed from my credit report? TIA.

    What kind of idiot would evict someone that's given their 30 day notice? It usually takes at least a month to evict someone.

    Good thing you're getting a divorce. He's an idiot. Big deal if you stay a few weeks longer. He should be happy you found a place & are going to move. You won't be evicted under these circumstances. Just explain this to the judge.

    They have no grounds for eviction at this point. You gave proper notice of vacating and unless your landlord has someone ready to occupy the home, most landlords (and the law) allow you to become a month to month tenant.

    There has to be a reason for an eviction. There are more reasons than money that can get you evicted.

    they can try to evict you, but on what terms? also, it takes longer thatn 30 days to get someone out, so if you already gave your 30 days, I'm confused...

    No, they cannot evict you unless they have legal grounds to do so. You gave proper notice, your rent is paid, and it does not sound like you have violated the lease in anyway so no they have no legal grounds to evict you.

    they won't go to the expense of eviction besides it could take months to evict someone
