A bunch of cops came into my house looking for a gun that was lied about, didn't find a gun obviously because it didn't exist?

But they did find a bag of pot with 2oz's in it, they arrested the guy who lied about the gun, took the pot that the (liar) stashed... Never wrote any citations, tickets or etc... Now 3 years later they are trying to pin the pot on someone that resided in the home at the time. What can be done? What might happen? Is there anything these ppl can do? Incident occurred in 2012. I dont understand why people ask questions like this and leave out the most important detail: what evidence is being used against the accused. Your Question says nothing about the evidence linking the pot to the people Ben g accused. None of that stuff in your question is evidence. It's the evidence that determines what kind of case can be made and how.

Oh and by the way the fact that a gun isn't where cops searched for it doesn't prove that the gun was never there.

If they think they can prove their case, they will prosecute. The acused will have to mount a defense.
