Did Bush make the same mistake in appointing Chief Justice Roberts as Eisenhower did in appointing Earl Warren?

    No, I don't see much similarity there (between those two appointments). John Roberts is still pretty conservative a lot of times, and he surely is far different than Earl Warren, ideologically.

    I happen to think that none of Eisenhower's appointees were very good.

    I don't think so. Roberts' decisions are predictable if you know Roberts. Warren's decisions were out of character from his earlier life. Warren was Eisenhower's Thomas ap Becket. Fortunately, nobody asked in exasperation whether someone would rid them of a troublesome jurist.

    I get that partisans are upset with Roberts. Roberts has been deciding things with his eye almost exclusively on the finding a way to allow egislation to remainintact. The archetypical oppsite of an "activist" jurist. Warren, onth eother hand, sought to change things to what he thought they should be. Roberts is faithfully executing the office of Chief Kustice of the Surpreme Court. Even when I disagree with the ideological ramifications. He has to be the least ideological CJ in my lifetime. Frustrating, but refreshing jus the same.
