Not at fault car accident, insurance lapsed at the time, other driver has full coverage. Should I get a lawyer?

I didn't have insurance over the weekend because I didn't have the money to pay my policy on time (which has since been fixed but still doesn't change anything relating to the accident). My car is no longer operable, due to the other driver attempting to pass me on a two lane road, while I was making a left turn. I have tried calling their insurance company but keep getting put on hold for extended periods of time or told to call another number. I still have no idea if they have filed a claim, which I would like to file one myself if they haven't done so. Can I file a claim with their insurance company or should I seek a lawyer's assistance?

    Only if this happened in a state where a person without insurance can get any money from an accident caused by a person who had insurance. Many states now have laws saying that if the person who caused the accident has insurance, then any driver who doesn't have insurance can't get paid.

    Since last weekend was a holiday, most insurance companies are slammed with a lot of new accidents.

    Yes, you can file a claim, but maybe need to be patient to get through to the right person. So, stay with it, till you can get the claim filed. Once done, then they give you a claim number, and the name of the adjuster and phone to contact.

    Lawyer? If no injuries, NO lawyer will take. Lawyers don't give a crap about your vehicle damages.

    Your major problem is that you did not have current insurance coverage for your vehicle at the time of the incident. Because of this you have no one but your self to represent your interests in this situation. Hire legal counsel? I doubt you would find a lawyer interested in such a case. You will have to deal with the big bad insurance provider of the other party all on your own.

    If you only have property damage, don'[t hire a lawyer. You will have to pay him. If the other driver or his insurance do not cooperate, file a complaint with the insurance commissioner in your state...if you are in the US
