How would my boyfriend go about getting his phone back?
My boyfriend was arrested on violation of probation charges last year and his cell phone was seized as evidence. On the day he was arrested, he was told that when he was released, he would get his phone back. Originally when I called the probation office about it earlier last year, I was told that it was at the probation office and if he went there after getting out of prison, he'd get it back again. He got out of prison recently and he's been to both the probation office and his county's sheriff's office and both of them told him that his phone isn't there and to try to contact FDLE and talk to the records department. Is there any way they could mail his phone to him? What would he have to do to get it back?
My boyfriend was NOT involved in anything to do with drugs. His phone was taken because he was accused of talking to someone with it that he was court ordered not to talk to

Seriously who uses their main phone to conduct drug deals?? Hasn't he ever heard of a $10 Tracfone? Anyways, if his phone wasn't used for drug deals and was collected as evidence for something else then they will probably give it back once the case is considered "closed" and they search through all his contacts.
Honestly I wouldn't accept the cell phone back anyways if I was in this situation because who knows what kind of bugs and spy devices they've implanted in his circutboard! Anything he does on the phone including your intimate text messages between each other will be MONITORED and READ which is not something you want. I would just buy him a new phone if I was in your shoes.
I think it's better to protect your boyfriend's privacy and get him a fresh device instead of having to worry about what kinds of spyware they've added to his phone. It's just not worth the worry. If they do release his phone then just sell it on eBay/Amazon so you'll get some money back. Of course, don't put in the description that it was collected as evidence lol. Good luck!
