Life Insurance Policy and Mother has passed away.?

Life Insurance Company contacted me regarding my Mothers Life Insurance, they had me send original papers showing her Birth Record and her Death certificate. My name was not on her policy however all the relatives have also died including the execitor of her estate. I am 74 and wondering what to do now they say since my name was not on her policy, I can not collect. Then why did they contact me? Do I need an Attorney? What should I do?

    you send them a letter (date and keep a copy) or email telling them that all the relatives+ executor are now deceased and ask them what they want you to do

    (dont go into details of the relatives such as the date or place of death - they dont want your help then let THEM find out -

    information has a value so you should be careful not to give them too much unless they pay for it

    remember- since you are not named on the policy you can charge for helping them including the costs of any documents they require (such as death certificates)

    so bear thing in mind if they ask you to do something

    just send them (by letter) your fee for doing what they want before you do anything

    worst that could happen is they wont pay you - so YOU dont do anything

    second thing to remember is- they have a legal duty to use their best efforts to trace the beneficiary or their descendants

    without your help this could cost them time and money

    and YOU already know the policy existed so they cant ignore it

    As already said- you could get a lawyer to handle if for you and tell him to bill them for his services,AND add your fees as well as his - cos YOUR time and information also has a value as well as his, and without you the lawyer cant make a dime

    Its possible that when its sorted out YOU wont get anything from the policy. So unless you do this you wont benefit at all but your work will have helped others benefit

    The contacted you so that you can get the process started. If the executor is dead, then you have to go to probate court and get a living person appointed as the new executor. Also, someone needs to provide documentation to the insurance company that everyone on the policy is dead. Then they pay the "estate" and the new executor distributes the money.

    Just call the life insurance company and ask questions on who gets the money. The insurance company is not your enemy. They will honestly tell you what will happen, when and why. Talk to the insurance company. They will help you.

    Your name doesn't necessarily have to be on the policy. It could be noted down the branches of decedents of the beneficiaries. Why not go through the exercise and see what happens?

    Ask a lawyer. HER insurance policy would NEVER have your name on it.

    If the beneficiaries predecease the insured, the proceeds go into the estate. Are you the executor or administrator? Assuming yes, that s why they contacted you.

    comply with their requests you very likely are the only one they can find of her relatives who would be eligible for her insurance

    that's their business, if they can't find someone to issue the money to it is turned over to the state

    Who are the people on the policy?

    Who are their heirs?

    That's who will get the money.

    You don't deserve the money since she never added your name to the policy.
