How are big companies allowed to use instagram photos from their users?

I think it's common knowledge that you can't steal someone's photos from instagram to just post wherever you want, but there are loads of competitions where a company will say post a certain kind of picture with a certain hashtag and you could be featured in blah blah blah publication.

Seems innocent enough. Chances are that the person wants to be featured in whatever publication by virtue of using the hashtag. But since a company can't "own" a hashtag, do they still get written permission from the owner of the photo? Or do they take their chances?

If you are uploading a photo with that hashtag during a contest or promotion, you are in effect giving that company permission to use your photos. it's implied consent
