    sell the cups for $5.00 and give the beer for free. that way you are not selling beer

    Yes, if you don't have one and you give or sell your beer to a customer your business can be shut down & you can be fined.

    If you SERVE intoxicating beverages, you will need the corresponding licenses. Doesn't matter if you "sell" it or not. If you buy it and hand it out, odds are very good you need a license.

    Moreover, depending on the state you could run afoul of other laws related to alcohol marketing that prohibit this kind of thing.

    No. A liquor license allows you to SELL liquor. However, until you hold a liquor license alcoholic beverages can be given away at not cost in a restaurant establishment.
