My rent check was stolen and cashed by someone else. My bank's giving me the runaround... what can I do?
I live in NY State. I made out a check for my rent, and found out 2 months later that somehow someone stole the check and cashed it to their personal account. The check wasn't even endorsed, yet the transfer of funds was authorized. I've been in a back-and-forth with my bank's claims department since February, but I'm still getting the runaround. What else can I do to get this resolved? My landlord's hassling me, and I simply can't afford to scrounge up an extra month's rent that should've already been there.

If your bank wont help you, then get the government involved, it's why we pay taxes!

if you have a copy of the cancelled check, front and back and there is no endorsement this is a problem with the bank and if nothing else contact the state board that governs banks in your state and report this

I am having a difficult time understanding how your check was stolen and you either gave it to your property manager, places it in a box designated for rent payment or you mailed it to your landlord or property manger.
Apparently this has not happened before and you did he the same method of paying.
This financial crises is not a problem of your landlord. Your landlord has not been paid the rent they are due. Your landlord in not hassling you, they want you to pay your rent.
It is not your landlords fault that you are not financially prepared for financial difficulties or emergencies.
Apparently your bank was presented a legal check signed by you and paid this check. This is an issue might take a long time to solve if it is ever solved.
Your bank have no idea who you would give a check to and is required to pay each check presented to them signed by you. They would not call you each time you write a check to see if this was the person you issued the check to.
Unfortunate there are dishonest individuals in this world, you were found by one.
You would be required to make some sort of financial arrangement with your landlord to repay the month of Feb rent.
You might use a more secure method of paying your rent each month. You might use online banking through your banking institution, and pay directly to your property manager from your bank account
You might also pay by debit card, issued by your bank.
There is no charge for the use of these services, however they offer more protection than writing a check.
I hope this has been of some benefit to you, good luck.

Get a letter from your bank explaining what is going on. That may help a bit.

Sue the person who had control of the check when it was stolen. You can do it in small claims court without an attorney.

It sounds like your bank is not the bank that cashed the check. Ask your bank how to dispute it with the bank that cashed it. You might have to go directly to that bank. The fraudulent cashing is a separate issue from your landlord issue. Your failure to have enough savings to cover emergencies is your shortcoming, not the landlord's problem. You shouldn't be renting what you cannot afford and this is one reason why - because issues do arise. Since you are already stuck, expect to scrounge and pay a late fee too. Maybe you have a parent you can borrow $ from. Get a temporary second job and start saving money so that you don't find yourself in a bind again.

as far as getting back that $$ - not very likely, and even if the bank can find out who cashed it ( again not likely ), then it can be a long time before you are reimbursed for the funds......I know because the similar thing happening to me, and it was at least 1 year before the funds were restored to my account......as for your landlord - presumably you have sent them a copy of the check ?? that's all you can do for now, and just ask for their patience especially if you have been a good tenant & paying the rent on time
