If you knew someone personally who had been raped/sexually assualted, surely you would still want them locked up even if it was brought up 40 years later

In Alabama incest is normal and even farm animals are fair game so he is the perfect candidate.

These incidents against women or girls can carry a lifetime of anguish. This is why the law respects charges of molestation even though they are very old. However, for most people who've not been involved in such molestation, it seems wrong to punish someone for something that happened 40 years ago.
