They will let you make a new account just behave yourself on it to avoid future bans.

It depends on the severity of the offense that incurred the ban.

Unless it was a console ban (which is typically the worst, as it prevents any other accounts log into XBox Live), you can create a new account. Please be aware that you'll be starting ALL OVER with the new account (as you cannot transfer ANYTHING from the banned account to your new account). This means that any purchased digital content (digital titles & DLC), anything in your XBox Live wallet, your GamerScore & your achievements WILL BE LOST in the process.

If you have been hit with a CONSOLE BAN, you will have to purchase a new console altogether (on top of creating a new account) since nobody (legit or otherwise) can't sign into XBox Live for ANYTHING (game patches, DLC, digital games, ect.)

Please be aware that Console Bans are usually reserved for severe violations of XBox Live's policies (like modifying the hardware to support software piracy) as well as repeat offenders (receiving multiple account bans on the same console). This is something that Microsoft does not issue lightly as Console Bans are PERMANENT & IRREVERSIBLE. As a result, console bans SEVERELY REDUCES (IF NOT DESTROYS) THE RESALE VALUE of the system as it can only be used offline. Since XBox Live is a core part of the XBox One's services, it makes the console HIGHLY UNDESIRABLE (making it very difficult to sell) as you will have to disclose this when listing it online to avoid site-enforced returns (as failure to disclose this can be considered a deceptive & fraudulent tactic).

Such bans (both account & console bans) with any game platform are designed to heavily punish you in your wallet for breaking that company's policies, since the replacement costs of the accounts becomes increasingly expensive as the account matures (it's harder & way more expensive to replace the contents of an account that's 5 or 10 years old versus an account that's only 3 months old)... which helps ensure that more tenured users will behave.

Hope this sheds some light on the subject.

Unless your console's also been banned, then yes you can make a new account.

Nothing from your current account carries over. Any Xbox Live Gold, DLC, or games won't be transferred.

possibly. depending on the severity of it, it may not matter since they have your IP address. they will recognize that the next time you try to sign on.
