Is bank burglary a federal crime, and if so which court is it tried on?

    Theft from a federally insured bank is a federal offense, whether the theft is part of a burglary, robbery or embezzlement. It is also a state crime. Where it is tried depends on which files the charges. Sometimes one is charged in both state and federal courts.

    Burglary of a bank is both a state crime and a federal crime. The prosecutors will decide which court is the best option for a conviction. Often they will go to federal court because it is a more "permanent" felony because there is no federal expungement opportunity.
